Terms of Service

These terms govern your use of the F&H STAC website (fhstac.com) and, together with your signed services agreement, the software we provide. F&H STAC is operated by F&H Enterprises, LLC ("F&H STAC," "we," "us"). By using the site you agree to these terms.

Paid engagements are governed by the individual services agreement (statement of work) you sign with us. Where these website terms and your signed agreement differ, your signed agreement controls.

The service

F&H STAC designs, builds, hosts, and supports custom HSE compliance software configured to a client's operation. Scope, deliverables, timelines, and fees for any engagement are defined in a written proposal / statement of work.

Website use

This website is provided for information. You agree not to misuse it, attempt to disrupt it, or use it unlawfully. Content, branding, and design are owned by F&H Enterprises, LLC.

Proposals & fees

Any pricing shown on this site is indicative and subject to a written proposal. Fees, payment schedule, and terms (for example, build, annual license, and support retainer, with a 12-month minimum term) are set out in your agreement.

Client responsibilities

Provide accurate information needed to configure your suite.
Manage your own users and their access, and keep credentials secure.
Use the software in compliance with applicable laws and your own regulatory obligations.

F&H STAC is a tool to help you run your safety program. It is not a substitute for professional judgment, and using it does not by itself guarantee regulatory compliance or any specific outcome. Responsibility for your safety program and regulatory compliance remains with you.

Your data

You own the data your team enters. We process it to provide the service as described in our Privacy Policy. You can request full export (CSV / JSON) at any time, and your data is permanently deleted within 30 days of contract end unless otherwise required by law or agreed in writing.

Availability & support

We work to keep the service available and to turn around agreed changes promptly. Specific support levels and response commitments are defined by your chosen support tier in your agreement. Hosting and infrastructure are provided through Supabase and Netlify.

Warranties & disclaimers

We provide the software and website with reasonable skill and care. Except as expressly stated in your signed agreement, the service and website are provided "as is" without other warranties, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, F&H Enterprises, LLC is not liable for indirect, incidental, or consequential damages. Any liability limits and remedies are as set out in your signed agreement.

Term & termination

Engagement term, renewal, and termination are governed by your signed agreement (12-month minimum term). On termination we provide data export and delete your data within 30 days as described above.

Governing law

These terms are governed by the laws of the State of North Dakota, USA, without regard to conflict-of-laws rules.

Changes

We may update these terms from time to time; the "last updated" date reflects the current version.
